JUDGE RULES JURY MUST DECIDE IF WHOPPER IS, IN FACT, A WHOPPER
What actually happened: Burger King must face lawsuit claiming its Whoppers are smaller than advertised
IDIOCRACY LEVEL: 7/10
In August 2023 a Miami federal judge refused to dismiss a proposed class action claiming Burger King's menu-board photos make the Whopper look about 35% bigger, with over twice the meat, than what is served. Claims over TV and online ads were dismissed; contract, negligence and unjust enrichment claims survived.
The courts of the land have taken up the burning question of the age: is the burger as big as the picture of the burger? Customers say the menu images show fillings spilling over the bun, making the sandwich look about a third larger than reality. Burger King insists the patties in its ads are the same patties it serves, but the judge said reasonable people on a jury should decide. Expert witnesses are expected to testify while eating.
